Each and every organization or sector makes use of technology in either offering or providing their services to the clients and in communication. In one way or another it has impacted the operations either positively or negatively. In health sector they have also made use of technology in offering their services. Telehealth is the use of technological digital information and communication technologies for example the use of mobile devices and to access health care services from a distance remotely and manage an individual’s health care. According to (Alonso, 2019) telehealth become commonly used in rural America area. These may be the technologies that someone can use them from home or a doctor can use them to improve or support health care services. According to (Darkins & Cary, 2000) telemedicine can be defined as health care carried out from a distance. A patient with prescription of taking drugs daily and with close monitoring of the professional expert will find it easy to access the health care facility from home in a more convenient way than visiting the health care facility daily. From the figure shown below it shows that the personal well-being of an individual in telehealth care depends on the technology, social alarms and eHealth. Fig: 1 Legal issues in telehealth Legal issues related with telehealth care include means of licensing and jurisdictional regulation of practices and standards. In some countries it’s still not clear whether the health care of patients takes place at the patient’s location or at the health care facility location. If there will be no interjurisdictional agreement, the physical location of the patients at the time of interaction should remain the key factor in determining the applicability of local licensing and the necessary requirement to offer licenses to professionals. Another legal issue is the reimbursement. Finding means of funding this nonphysical medical services is also a challenge to the service providers. The legal organizations of different counties need to come up with rule and regulations to control the traffic and the use of telemedicine incentives. Finally the last legal issue is all about the privacy of the operations. Confronting Legal issues. This is one of the most of the institutional concern and requirement of other clients that their information should be kept in a safe and secure manner. The protection of the electronic document information is governed by the electronic document Act which offers required standards as per the accuracy, security and access Confronting Legal issues in Telehealth Law The government through the department of the health and human services, other government bodies/sectors and the healthcare facilities should come up with telehealth solutions to be implemented to help address the legal issues related with telehealth services to make them be the best practices. According to (Rockville, 2011) telehealth programs should have the best practices for then to be effective. The confrontation will address and focus on mean and ways of coming up with programs which will help to make licensing of the telehealth care services to be easier and portable. This can also be done by providing technical assistance and helping in coming up with sustainable policies which will help strengthen the service and enable them to have the quality they deserve. To address this issue of persons offering medicines without professional licensing in telehealth services, the law must be enforced boldly should to address this issue as a criminal offence and charged in the court of law as an offence against human rights, to be as a lesson to whoever who may think to practice the same. Physical education can also be used to educate the service providers on the license requirements and the need Another confrontation is on addressing the ethical practices in the industry. According to (Stoll, 2020) ethical challenge making telehealth services have limitations should be addressed. This ethical challenge include the relevant technical challenges which may hinder the security or privacy of the service offered. Relevant services providers should work tirelessly and around the clock to ensure that always the security and the integrity of the patient information is protected. This is made possible by Installation of information and technology security features on both ends of services delivery (Cannella, 2019) Conclusion Telehealth care is concluded to be an easy way of accessing healthcare services without visiting the health facility to some patients. Equally as far as the global pandemic is concern (Covid-19 protocol is concern) physical visitation to the health care facilities is discouraged to reduce the spread of the virus but some other patients need to visit the healthcare facility for better diagnosis of their problem before joining the telemedicine services. The government and the hospitals need to address the legal issues in telehealth law to ensure that the system is able to work effectively. Expansion of this telehealth services should be done to every country and to the local level to help to reach every person in need of this service and this will also help in reducing congestion in hospitals.
